Welcome to CIRRA Web Design. These Terms of Service ("Terms") govern your use of our web design and hosting services. By engaging our services, you agree to these terms.
1. Services Provided
CIRRA provides the following services:
- Custom website design and development
- Website hosting and maintenance
- Monthly updates and technical support
- Basic SEO optimization
- Mobile-responsive design
- Web apps (coming soon)
- Marketing tools and services such as a google business account set-up and boosting (SEO service)
2. Payment Terms
2.1 Monthly Subscriptions
Our standard packages are offered on a monthly subscription basis:
- 5-Page Website: R300 per month
- 7-Page Website: R500 per month
- 15-Page Website: R1000 per month
- E-Commerce Website: Custom pricing based on requirements
2.2 Payment Schedule
Payment is due on the first day of each month. Services may be suspended if payment is more than 7 days overdue.
2.3 Free Trial Period
Some clients may be offered a free trial period of up to 3 months. After the trial period, standard monthly rates apply unless otherwise agreed in writing.
3. Client Responsibilities
As a client, you agree to:
- Provide accurate business information, logos, images, and content
- Respond to requests for information in a timely manner
- Review and approve designs within the agreed timeframe
- Ensure you have the rights to all materials you provide
- Maintain payment obligations as outlined
4. CIRRA's Responsibilities
CIRRA agrees to:
- Design and develop your website according to agreed specifications
- Provide hosting services with 99% uptime guarantee
- Perform monthly maintenance and updates
- Respond to support requests within 48 hours
- Keep your website secure and backed up
5. Revisions and Changes
5.1 During Development
During the initial website development phase, you are entitled to unlimited revisions until you approve the final design.
5.2 After Launch
Your monthly subscription includes minor content updates and changes (text, images, contact information). Major redesigns or new features may incur additional fees.
6. Intellectual Property
6.1 Your Content
You retain all rights to content you provide (text, images, logos, etc.). By providing content, you grant CIBRA a license to use it for creating and maintaining your website.
6.2 Website Design
The custom design elements created for your website become your property upon completion and payment. However, CIBRA retains the right to reuse design techniques, templates, and code structures.
6.3 Portfolio Use
Unless otherwise agreed in writing, CIRRA reserves the right to display your website in our portfolio and marketing materials.
7. Cancellation Policy
7.1 Cancellation by Client
You may cancel your subscription at any time by providing 30 days written notice. No refunds will be provided for partial months. Upon cancellation:
- Your website will remain active until the end of your paid period
- After the paid period, your website will be taken offline
- You may request a backup of your website files for a fee of R500
7.2 Cancellation by CIRRA
CIRRA reserves the right to terminate services if:
- Payment is overdue by more than 14 days
- Client violates these Terms of Service
- Client's website contains illegal, harmful, or offensive content
8. Website Ownership and Hosting
While you are subscribed to CIRRA's services:
- CIRRA retains control of hosting and technical infrastructure
- You have rights to your content and custom design elements
- Upon cancellation, you may purchase website files and database backup
- Domain names registered through CIRRA remain your property
9. Uptime and Technical Issues
CIRRA aims for 99% uptime but cannot guarantee uninterrupted service due to:
- Scheduled maintenance (with advance notice)
- Hosting provider issues
- Force majeure events
- Internet service disruptions
CIRRA is not liable for lost revenue or damages resulting from website downtime.
10. Limitation of Liability
To the maximum extent permitted by law:
- CIRRA's total liability shall not exceed the amount you paid in the last 3 months
- CIRRA is not liable for indirect, incidental, or consequential damages
- CIRRA is not responsible for third-party services (payment gateways, analytics, etc.)
- You are responsible for maintaining backups of your critical business data
11. Content Guidelines
Your website must not contain:
- Illegal content or services
- Hate speech, discrimination, or harassment
- Copyrighted material you don't have rights to use
- Malware, viruses, or malicious code
- Adult or explicit content (unless specifically agreed)
CIRRA reserves the right to remove content that violates these guidelines.
12. Third-Party Services
Your website may integrate with third-party services such as:
- Payment processors (PayFast, PayGate, etc.)
- Google Maps and Google Analytics
- Social media platforms
- Email marketing services
These services are governed by their own terms of service. CIRRA is not responsible for their functionality or changes to their services.
13. Confidentiality
CIRRA will keep confidential any proprietary business information shared during our engagement. However, this does not apply to:
- Information that is publicly available
- Information required to be disclosed by law
- General design techniques and approaches
14. Testimonials and Reviews
If you provide a testimonial or review:
- You grant CIRRA permission to use it in marketing materials
- CIRRA may edit for length and clarity (but not meaning)
- You may request removal at any time
15. Warranty Disclaimer
Services are provided "as is" without warranties of any kind. CIBRA does not warrant that:
- Your website will achieve specific business results
- The website will be error-free or uninterrupted
- All bugs or issues will be immediately resolved
16. Governing Law
These Terms are governed by the laws of South Africa. Any disputes shall be resolved in the courts of Gauteng, South Africa.
17. Changes to Terms
CIRRA reserves the right to modify these Terms at any time. Clients will be notified of significant changes via email. Continued use of services after changes constitutes acceptance of new terms.
18. Force Majeure
CIRRA is not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, power outages, internet disruptions, or government actions.
19. Entire Agreement
These Terms, along with any signed proposals or agreements, constitute the entire agreement between you and CIRRA. Any modifications must be made in writing and signed by both parties.
